Many people are under the misguided notion that the government has unregulated taxation authority. This is not the case at all. All taxation is regulated by the U.S. Constitution. Article I states that all indirect taxes must be uniform across the States. It further states that all direct taxes (i.e. ad valorem taxes) must be levied in proportion to the census and enumeration. Article VI of the Constitution states that the U. S. Constitution is the supreme law of the land and must be adhered to by all state legislatures and judiciaries. With the supremacy clause in place, any state constitution that is in direct conflict with the U.S. Constitution should be unconstitutional. If any state constitution is allowed to take precedence over the U.S. Constitution it would render the entirety of the U.S. Constitution null and void and make the U. S. Supreme court irrelevant and unnecessary.
With this being the case, the current property tax schemes across the country are potentially unconstitutional. Property taxes are direct taxes and must be levied in proportion to the census and enumeration. Even more disturbing than this is the fact that businesses are being charged property taxes but are not counted in the census and enumeration. Businesses are charged direct taxes on all their property, equipment and inventory values without representation in the census as required by the U.S. Constitution. Additionally, taxing jurisdictions (i.e. school boards and local governments) use bond elections to fund public projects. These bonds are voted on by all the registered voters in the jurisdiction without regard to property ownership. Therefore our non property owning neighbors can, in effect, vote to raise our taxes without the responsibility of paying the taxes themselves.
How do we fix this? Our intention is to raise the funds to hire a staff attorney to bring suit in federal district court to have these taxes declared unconstitutional as well as working with legislators to rectify the discrepancies in the laws. If successful we will change the way taxes are levied and make the tax system in our country more fair and equitable while forcing our elected representatives to work within the bounds of the law. We intend to challenge the status quo all the way to the Supreme Court if necessary. If successful this will change the laws across the country much like the Supreme court decision on gay marriage a few years back. As I'm sure you know a journey through the court system is very expensive and quite time consuming. To this end we are trying to raise the funds for this journey. Any monies collected and not used will be donated veterans causes after the final disposition of our legal case.
